By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions.

General

These Terms and Conditions set forth the entire understanding and agreement between us. We may amend these Terms and Conditions at any time by posting an amended agreement on our website. Any amended Terms and Conditions will govern new user registrations from the date that it is posted and existing users will be bound by the amended agreement after the expiry of 14 days following the date of posting.

Nothing in these Terms and Conditions shall create or be construed to imply any agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship between you and us. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section.

If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in full force and effect.

You cannot assign this agreement but we may assign it at our sole discretion.

Our failure to act with respect to a breach by you or others shall not be considered as a waiver of our right to act with respect to subsequent or similar breaches. Any person who is not a party to this agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement. This does not affect any right or remedy generally available to such a third party in law or otherwise.

Governing Law

This website and our Terms and Conditions have been designed for use within the United Kingdom and under UK law. Whilst we are happy to consider requests for products and enquiries from outside the United Kingdom, we give no warranty, express or implied, that the use of this website or the placing of any order through this website from outside the UK complies with any applicable non-UK laws or regulations. Accordingly, any products or promotions not permitted under your local law are not offered to you.

A Contract between the customer and Yes! SuperBaby Ltd for the sale of our products will only exist once an order has been accepted, processed and despatched. For the avoidance of doubt, receipt on an order via our Site does not constitute acceptance of an order. This does not affect the customer's statutory rights. Prices and availability of goods is subject to change without notice.

Your Right To Cancel

You may cancel the contract without reason before the expiry of 7 working days from the date of receipt of goods. If you do cancel the contract within this time any payments made by you will be refunded in full within 30 days. You will be required to return the products in question to Yes! SuperBaby Limited in perfect condition, unused and in their original packaging.

Please note that if your order has been processed we are unable to cancel it and therefore return costs are at your expense.

Returns Policy

We hope you will be pleased with your purchase. Should you wish to return anything bought from us, we will be happy to offer a refund or an exact replacement for your return, provided it is in fully resaleable condition, and returned within 14 days of delivery. If we find that the product has not been returned to us in fully resaleable condition, we reserve the right to refuse a refund on the item.

Your refund or replacement will be processed as soon as possible, and you will be refunded in full within 30 days. A refund of the delivery charge will be given in the instance of incorrect, damaged or faulty goods. It is not possible for us to refund the original cost of delivering the item/s.

Payment

We accept online payment in a secure environment by credit card or Yes! SuperBaby Gift Vouchers. We currently accept Visa, Mastercard, Delta, Switch & domestic Maestro. All transactions are shown in £ sterling.

All prices quoted on this website are accurate at the time of publication and are quoted in pounds sterling (£). Any customs or import duties levied once the package reaches your destination country will be your responsibility as we have no control over these charges and cannot predict them.

Delivery

If your goods are in stock they will be dispatched within two weeks of receiving the order by registered post. However, most orders are dispatched within a few days. If, for some reason they are out of stock, we will inform you of the expected delay immediately.

If the delivery address refuses delivery of the goods, or if you do not respond to the collection card left by your postman, your order will be returned to the sender and you will be charged for the return of the order.

If you provide us with a wrong delivery address and your goods are signed for by another party, we cannot be held responsible for any loss you incur as a result.

• International Delivery (Europe) - £ 6.00
• International Delivery (Other countries) - £ 12.00

We have made all reasonable efforts to accurately display the size, colour, and shape of the goods for sale on www.yessuperbaby.com. Colours in particular may differ due to your own computer visual settings and hardware.

All products displayed on this website are available only while stocks last. Prices and availability of goods is subject to change without notice.

Disclaimer & Limitations of Liability

To the fullest extent permitted by law and save as provided above, neither Yes! SuperBaby Ltd, nor any associated company shall be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of Yes! SuperBaby Ltd or any of its members, agents, directors, employees or otherwise) for any indirect special or consequential loss or damage, costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of the products or their use by you.

You may not assign or transfer any of your rights or sub contract any of your obligations under these terms and conditions except with the specific permission in writing of Yes! SuperBaby Ltd.

No person who is not a party to these terms and conditions shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999. Nothing in these conditions is intended nor shall affect any of your statutory rights that may not be legally excluded.

Indemnity

You agree to indemnify and hold us and our affiliates and agents and our and their respective officers, directors and employees harmless from any claim or demand, including legal fees, made by any third party due to or arising out of your breach of this agreement or your violation of any law or rights of a third party.
